emergency parole
My brother back home was suddenly diagnosed with kidney cancer, and it has spread to his liver and lungs. πππ
My question is β please, please answer me.
I want to go to my home country to see him.
I came to the USA on a K-1 visa. My husband was abusive, and I separated from him after 11 months and 23 days. We separated, and we never went to the interview. He also never approached me for the interview.
However, he used to contact my parents back home almost daily and emailed me asking to reconcile, but he never asked me to go for the interview. I also did not go because I was not mentally stable due to the abuse.
My lawyer never applied for my travel permit. I currently have a work permit, and I am working legally. My I-360 application has been pending since March 2023.
If I apply for emergency Advance Parole, what are the chances that it will be approved?
If I receive Advance Parole, is it safe for me to travel from Houston, Texas and return to the USA?
Please guide me.

I am also a K-1 visa holder. I once applied for Form I-131 because I wanted to return to Vietnam to visit my elderly mother who was seriously ill. However, my lawyer strongly advised me not to leave. She said that if I left the U.S., I might not be able to come back.
I cried a lot and felt very helpless, but in the end, I didnβt dare to leave. It was one of the hardest decisions in my life.

If you plan to travel with Advance Parole, always make sure you are very well informed about your immigration case. CBP officers may send you to secondary inspection and ask detailed questions about your application, especially now due to increased fraud cases.
It is strongly recommended to carry copies of your immigration forms (such as the I-360 or I-485), your work permit, Social Security card, and any other documents that help prove your legal status in the United States. Immigration already has all your information in their system, so being prepared is key.
I traveled to my home country for two and a half weeks and was able to return safely to the U.S.

apply for an advance parole and get a statement or report from your brothers doctor to support your application for advance parole and submit it

Call USCIS for an info pass and they will set a date for u to come in. Be very prepared before you go. Carry all necessary documents. Birth Certificates, Medical Records, Pictures of you and him together. Affidavit from a family back home stating heβs your brother. etc!
