Emergency Advance parole
Looking for similar stories / feedback: Because one of my family member is sick in my home country, I’ve managed to get an emergency parole (for 30 days) issued during my Infopass appointment this week (my expedited request for EAD has been refused). I’ve checked my mailbox today and found a notice of action (form I-797C) with a new receipt number stating that USCIS received my application for I-131 (in a new service center - NBC but my I-131, I-765 & I-485 cases have been in Nebraska - I’m EB-2 applicant). I’ve checked this receipt number online and the I-131 is approved. It’s confusing because: 1- I’m supposed to receive a combo card 2- I don’t know if this receipt is related to the emergency AP or the actual AP 3 - The status of my initial I-131 filled in Nebraska is still : “expedite request denied” (for a expedite request I’ve done 1 month ago) 4- In case they approved my I-131, I don’t know what it means for my EAD / combo card Has someone experience the same thing? Thanks!

not everyone is receiving combo card. if you need emergency travel, they’ll give you AP but not EAD. your Expedite request for AP is not the key to EAD though sometimes it triggers its approval. for now, think about the emergency back your home. i know you need it, but dont add stress with the EAD approval.

@Noy Pi - have you had the same experience? I’m trying to understand if the notice I’ve received is related to the emergency AP (which is not a AP).

if they approve your AP is legit.they don't approve the EAD yet.you ask for emergency parole

Emergency Advance Parole (EAP) is a standalone document, a separate entirely from EAD and AP. You have to pay separate fee for it, if already have a pending AOS. It is normal to be processed at a different service center. A combo card is issued if the work and travel permits are filed and approved at the same time. In my case, at Infopass I was offered an emergency AP for 30 days valid to go to one country for parent’s funeral, but not to visit another to see the rest of the family who can’s attend the funeral. It was not gonna be a problem but the officer mentioned that THIS WILL CANCEL MY INITIAL AP and I’ll have to file for it again with another 6-8 months processing!!! At that point I was waiting for 12,5 month for the combo card, so in tears I’ve declined the EAP in order to keep my original PD on the initial AP. Just a thought of another possible emergency and all this nightmare all over again made me go the hard choice. My lawyer called this bs. We filed for an expedite on my EAD/AP which is deep outside of processing times anyways. Hope your luck is better than mine! PD July 2020 for 360, 485, 765, 131 in VT, Local Phila fingerprints Nov 2020 infopass Aug 9th 2021 expedite filed on Aug 11 2021 Nothing since. Still hope somethin will be triggered. Hope my case is an isolated one. I’ve never heard that the emergency will cancel the initial application. Makes no sence. Anyways, wait for your emergency AP. Go home, see your family. Keep an eye on the status of your other applications. People report new work permits to be valid for 2 years. Not sure if it will be the case with combo cards. Good luck!

hi Jully - sorry to hear about your loss & this experience with USCIS. I did not pay any fee for the emergency AP. That’s bizarre they canceled your initial AP/EAD - is it something that your attorney confirmed? when you check online with your initial I-131 receipt number, what is the status?

I did not get the emergency AP. I have declined it when the officer mentioned that it will terminate my initial AP and to file over. The status is still Received on July 24 2020. The attorney called the officer a wicked person, but said they can get away with pretty much anything on their ‘discretion’. I honestly think he was undertrained. He thought the initial AP for c(9) is valid 6 month! We have filed an expedite based on over 5 month outside of processing, death certificate and my experience at infopass. Also the EAD is at 13 month and their estimate is 9,5 tops. Hope to get through to them and get a combo card. When I was scheduling and infopass over the phone, they said to bring a new filled 131, 575 fee and 2 passport photos. Glad you did’t have to pay. It is infuriating how there is no consistency, transparency and a lack of training given those people control a part of our lives.
