EB5 Unreserved Pending I-485
My I-526 was approved on May 31,2024. I did concurrent filing of I-485 in September 2022. When will i see any
movement ? Anyone in the same boat?

I think we barely get 7 percent per country limit out of that reserved category get only 140 GC for entire year. and also each green card count as one and not the one per family so for instant if you are family of four then they will count as four green card and not the one.

I am from reserved category as well my 526e approved in Jan 24 PD is Jan 23 and waiting on 485 now hope to see some movement in October

and just FYI every year they have 10000 visa for total eb5 and out of that 7 percent is per country cap so we barely get 700 visa for the entire year per country in total now if you are in reserved category then you are just part with 140

India, like other countries, is subject to the **7.1% per-country cap on employment-based visas, including the EB-5 visa, in the unreserved category However, for the set-aside categories (rural, high-unemployment, and infrastructure projects), this per-country cap does not apply**.
This means Indian investors can compete for the set-aside visas, which are distributed on a first-come, first-served basis regardless of nationality. The percentage allocated for these categories globally is as follows:
- **20%** for rural projects
- **10%** for high-unemployment areas (TEA)
- **2%** for infrastructure projects
These categories offer an opportunity for Indian investors to secure visas without being restricted by the 7.1% cap applicable to unreserved EB-5 visas.
Many Eb5 applications done late 2023 have I526 approved and that are not based on 7% cap

having said that do you think that per the uscis latest press release they said that they have used all unreserved eb5 visa? so have they utilize the reserved as well?
also I have my 526e approved in January 2024! PD January 2023. do I need to wait for October for 485? I fall in 20 percent rular projects

The USCIS may provide updates on whether unreserved visas have been fully used for a fiscal year, but this does not automatically mean that reserved visas (like those set aside for rural projects, high-unemployment areas, and infrastructure) have been used. Reserved visas are managed separately from the unreserved pool and are prioritized for specific categories. If you're in the 20% rural project category, your reserved visa should not be impacted by the utilization of unreserved visas, as they are distinct allocations.
Your I-526E was approved in January 2024 with a priority date (PD) of January 2023. If you fall under the 20% rural project set-aside, the typical October wait might not apply to you in the same way as it would for unreserved visa applicants. Set-aside categories do not follow the same per-country cap restrictions, which could mean you may not need to wait for October if there are reserved visas available and your case is ready for further processing.
However, the exact timing for filing your I-485 depends on the visa bulletin and whether the reserved category for rural projects is current (i.e., visas are available). You should monitor the visa bulletin closely.
In short, reserved visa categories are treated differently from unreserved categories, so you may not be affected by the exhaustion of unreserved visas. Your I-526E approval and the rural project category may allow you to proceed without the same delays. However, the availability of visas in the reserved category should still be confirmed.

@Sam P I ran through some math calculations.... looking at your category and you're past approvals your 485 is 3/4 months past approval stage. I am surprised it's not. but I think it's imminent anytime soon. fingers crossed

It’s been 8 months since my I-526 is approved, still I-485 is pending. I-485 was concurrently filed in September 2022. I-526 was approved in May 2024.

@Dhruv M that it is likely the changing between consular processing into concurrent filingn in my case cause confusions at DoS. i do have AP now but still hesistant to use, as it could be so close to done in the process already
