EB4 job lost
I’m EB4 applicant and due to personal reasons I lost my job… my law said EB4 is not eligible to 485j which means I can’t change employer… I need to vent. This process is really disappointing…I wish we can change employer just like other EBs…life is so hard😭

I believe you can look for another church to file I360 for you if your R1 status is still valid.

my 485 is still pending and have valid combo card. my law said I’m allowed to work for any employer under combo card. and see if they sponsor will hire me back.

@M S Is it true? that’s totally different from what I know. so as you said if you have EAD, then you could switch any employer with EB4 religious?

yes you can work wherever you want before the day 1 of your i485 approval or the green card or the sponsor employer( Who sponsored for your green card / filed your i360 ) has to agree to re- instate your position after approval of your green card. you have work for them atleast 90 days after your green card approval (its not necessary but for at good will)

i485 j is different and switching/ working for other employers because of job loss or financial loss in eb4 category is applicable and I literally seen more than 20 known ppl switched already and i485 also approved after switching the employer time frame just a info dont do as it is consult your lawyer / attorney but they didn’t give you a right solution i am scribbled here based up on true incidents occured past years

An EAD after you file a i485 allows you to work anywhere because it is a free market EAD. If you lose your original job while you are waiting for adjustment of status, you can’t help it. it’s beyond your control. But you can work elsewhere with your EAD until the green card is adjudicated. However, the immigration guys can deny the green card if they send you an RFE askin you to prove you will work for the original employer if they approve the GC. This is going by the law. But because people cannot be expected to hold on to jobs for years until the immigration takes its own sweet time, I believe they will just issue the GC because they understand it. if they don’t, you can always go to the courts to ask them to decide what is fair. What is happening now is unfair to legal immigrants.

@John D so true. with the current backlog it’s not fair to ask EB4 workers to stay with their current employers and NOT ABLE TO SWITCH for years. (5 or more now to get the GC?!) it can help the organizations and companies to abuse their employees too, in a way that they can control your GC application.

I can totally relate. Questions- some say yes and some say no in job portability. in USCIS website it says that the job portability for the BENEFICIARY of emplyment based visa of only eb1,2,&3 can port. As of applicants him or herself, it only says employment based visa applicants can port their i485 by filing supplement J, however, USCIS will grant approval based on similarity of occupational classification (including pay). I am seeking more clarity myself, my lawyer is working on it. Some of you are right, it’s not fair and employers tend to abuse us becos we have no choice, and under compensate us since we can’t go anywhere, anyway. I’m married to a citizen after I filed my application, I just can’t afford to apply another one through marriage. I can’t port my i485 from eb4 to CR1.
