Discretionary Factors (Negative) Bachelor's degree in finance is inconsistent with the stated career goal of working at McDonald's Did not cease other employment to focus on the qualifying position after receiving the interview notice Engaged BDV Services to find an employer solely for green card purposes — employer has no connection to the applicant's education or background Relocated from Pennsylvania to Kansas for McDonald's, despite a more relevant prior position (Production Technician at Sanofi in PA) Participated in a mock interview with an attorney before the USCIS interview, raising concerns about the authenticity and spontaneity of testimony Received scholarships/diversity funds potentially intended for those pursuing other career fields 3. Overall Discretionary Denial Positive factors (bachelor's degree, approved I-140, U.S. citizen child) did not outweigh the negative factors

this seems very doctored

most of the F1 student adjusting the status with EB3 unskilled has some kind of degree. how can we convince officer that our career goal is working unskilled jobs? even if we say thats our career goal, will they believe a person with bachelor/masters degree will do unskilled jobs?

@Mandem FC thank you. It seems like the officer was not convinced that the applicant will work for the sponsor and will likely move to a new position after getting his/her green card.

@D K I’m not sure as well. I have a masters degree and when I asked BDV they told me that having masters does not matter and even people with PHD have gone through this process

They are looking for smallest excuses to deny people. They just don't want anyone getting green cards. Immigrants are not welcome in US at the moment, both legals and illegals.

@Stressed out yeah 5 years we are talking about, the initial first year of full time done they dont care, they need latest year full time if asked for interview. People with 1/2 skilled jobs getting gc as they moved to different state from KC. One got approved from NBC with two skilled job and onr unskilled job (sponsor) so if one is going everyone is going we were told this is future employement no need to work before gc and think about it working in a minimum wage for almost4/5 years and later joined skilled job while maintaining unskilled job with employer is now a issue? Everyone I know who works at Mcdonald mostly has two jobs even manager level not only bdv clients in this economy. So working in another low paying job is fine but skilled job is not fine I am not understanding this? Working as a crew member with min pay forever no upgrade since you did not get GC, now we are the guinea pig in this new scrunity. they should sent everyone if this process is going to be unfair for some for same reason.

@Stressed out yeah mcdonalds I have seen never provided 40 hours for me unless you are manager or often people call out or very much short staffed - accouting 30 mins unpaid break!!!!

i think they are just looking for reason to deny at this point eb3 is weirdly explained or misunderstood heavily so people follow what others are doing but be the victim while lawyers say its fine you are not required to work for employer before gc
