EB3 Unskilled Kansas City FO
Hello everyone,
Has anyone got approval from Kansas City FO? There is a post circulating in Reddit where an applicant was denied as they were not able to provide the information that USCIS was asking for. The employer is Mc Donald’s and it seems like the applicant had not started work before the interview which USCIS has deemed as a grounds for refusal including the applicant having advance degree and other items. Also BDV’s legitimacy was mentioned in the denial letter it seems.
Does anyone know about this?

I happened to save the picture and pulled out the reasons
USCIS I-485 Denial Reasons
1. Inconsistent and Unreliable Evidence
Pay records were inconsistent and lacked evidence of full-time employment
The I-485 Supplement J (Job Offer/Portability Confirmation, dated Sept. 8, 2025) claimed full-time work at McDonald's, but records did not support this
2. Discretionary Factors (Negative)
Bachelor's degree in finance is inconsistent with the stated career goal of working at McDonald's
Did not cease other employment to focus on the qualifying position after receiving the interview notice
Engaged BDV Services to find an employer solely for green card purposes — employer has no connection to the applicant's education or background
Relocated from Pennsylvania to Kansas for McDonald's, despite a more relevant prior position (Production Technician at Sanofi in PA)
Participated in a mock interview with an attorney before the USCIS interview, raising concerns about the authenticity and spontaneity of testimony
Received scholarships/diversity funds potentially intended for those pursuing other career fields
3. Overall Discretionary Denial
Positive factors (bachelor's degree, approved I-140, U.S. citizen child) did not outweigh the negative factors

most of the F1 student adjusting the status with EB3 unskilled has some kind of degree. how can we convince officer that our career goal is working unskilled jobs? even if we say thats our career goal, will they believe a person with bachelor/masters degree will do unskilled jobs?

@Mandem FC thank you. It seems like the officer was not convinced that the applicant will work for the sponsor and will likely move to a new position after getting his/her green card.

@D K I’m not sure as well. I have a masters degree and when I asked BDV they told me that having masters does not matter and even people with PHD have gone through this process

@Anonymous A not really it was in Reddit and the letter looked legitimate. I’m not sure why would anyone try to deceive and what would they gain from it?
