EB3 unskilled attorneys and I485J
Hello folks, I’ve seen so many posts about using i485J. I contacted 2 different attorneys in the past about it but the answers weren’t favorable to me.
Attorney 1: you can use i485J if you’re changing employers within the same metropolitan statistical area and that the jobs are the same or similar as the one stated on your perm labor certification form
Attorney 2: “I’ve handled so many i485 cases and geographical areas are never barriers. I, however, haven’t handled an eb3-unskilled portability case in the past and I’m not sure if the same rules apply to those in that category”.
these two responses have left me confused. could you guys share any information about immigration attorneys you that have experiences in handling eb3 unskilled job portability cases for the rest of us to consult?

yes you can changes jobs no issue but with same field. and your new employer should aslo sign 485 j. example if you are fliping burger at mcdonald you can flip it at burger king as well or make taco at tacobell. but the burger king/ tacobell must to sign 485 j .if they dont you are screwed

yes geographical areas are not the issues and it does apply for all employment based green card.

Those who commented above are right
Geographical area does not matter
But your job responsibilities must be atleast 50% similar.
The similarities really depend on how you package it... it doesn't necessarily have to be complete like for like.
And you do not necesarily need a lawyer.
If you have your original I485... I485J is very similar... you can file it yourself really.
If not, go with attorney 2.. attorney 1 surely doesn't know his onions

@Barb B No, you don't even need to submit if you don't want to, you can wait till interview. You might as well just send it in
