EB3-UNSKILLED
Just dropping my thoughts on EB3-3 quagmire
1. Don't be optimistic about this, I have said it numerous times. Any lawyer giving you falsehope is a false prophet, this is going to be a long ride.
2. You don't have to be stuck with your employer if you're tired of your job... look for another and get your I485J filled and kept... if they ever call you for interview then you can submit. If not called for interview, then you're good. Don't stay stuck with a job you hate. DO NOT LET ANY AGENT/EMPLOYER BAMBOOZLE YOU WITH THREATS... IT'S ALL GYMNASTICS, THERE IS ABSOLUTELY NOTHING THEY CAN DO TO YOU IF YOU LEAVE YOUR JOB.
USCIS DOES NOT EXPECT YOU TO BE STUCK WITH YOUR EMPLOYER, THAT'S WHY THERE IS PROVISION TO PORT.
3. Your I485 will be judged on the certainty that YOU WILL WORK FOR YOUR EMPLOYER AFTER GETTING YOUR I485 APPROVAL, so delay resumption to your worksite as much as possible. USCIS even admitted to this in a recent newsletter; IT WILL NOT BE A PROBLEM IF YOU ARE NOT WORKING WITH YOUR EMPLOYER. So, for those with 2022 pd rushing to work with their employers, goodluck flipping those burgers till 2026.
I personally know someone who is almost clocking 2years working and no hope in sight still, and that is about to be the story of everyone with 2021/22 pd
4. EB3 Unskilled doesn't look like it will even be current in the next 7years, if you see anyone trying to still go into this, it had better be your only hope to be a resident and there is no other option for you. USCIS dedicated a whole newsletter to EB3 unskilled, so you know WE ARE COOKED!
5. Forget all the bullshit about being 10,000 visas available every year to EB3-UNSKILLED, from what I have seen in the last 2 years, USCIS us understaffed and lazy so goodluck if they even use 7k! visas are being wasted every year and the backlog will keep increasing! Number of those with approved I-140 doesn't matter no more, how much visas can the USCIS get out before the end of a fiscal year? I doubt they used 7k for 2022/2023 fiscal year.
Those with advice that can help this group, kindly drop your thoughts too
We are stuck in this together.
My PD is late 2021... and I have zeroed my mind to 2025, any person telling otherwise is only being a sweetmouth.

@Sungjun Cho put your mind on 2025 and get busy with something else. If I were you, I'd leave lawfully and forget I ever applied for I485 so you don't keep bothering yourself

@USCIS IS A MESS Its just counselor cases . and all the counselors applicant are coming with 3-5 family members. As long there is counselor backlog there is no hope for Adjustment pf status applicants. Also Go check the visa statistics from last few months from just vitenam Embassy post Ho chi man. they have Issued more than 1300 visa in this category in last three months. I’m not adding numbers from other post.
