I’m so sorry! I’m sure there is a means to appeal - do you have any idea what might have caused the NOID? was it tied to RFE?

what is the different between noid and rfe ?

rfe or request for evidence is the one they ask if there’s something missing that will help them reach a decision. noid or notice of intent to deny is something they send when they have made up their mind to deny your application. but even noid is without prejudice. you gather all papers again and apply. if all is well they will approve.

to the RFE asked for a letter from the employer to prove if the job was still available and a letter was sent from the employer ok now they sent NOID and I don't know about I'm very worried

What was the exact RFE? Have you changed job? What was your status before applying, were you out of status or work with out authorization for more than 180 days?

Something is wierd in this case. I've never heard a deny case with a eb3 with a i140 already approved....

what was the NOID about?

binyam, yes I agree with you. Each person knows about your case. Should be very bad to have a deny in the last step of the process 😔

this is the first case I found on the internet that I can actually relate. I also have an i140 approved for eb2 niw, but my wife's English is not so good and we thought I would be able to help her during the interview, but the officer did not let me and she had a really hard time understanding. so it took 18 months for them to schedule a second interview which turns out she just asked me for any new documents. I handled over my last two paystubs and told her my wife(the applicant) did not have recent paystubs since we were without our EAD for 8 months trying to renew and it had arrived 2 months prior when she was 8 months pregnant. now they sent and a noid asking for tax transcripts and to write how we provided for our family during this time. we did not work and we had savings, so we are submitting our bank statements from the date we stopped working to the date I started working again. but that makes me wonder about it every night even with the lawyer help. I keep asking myself if I should submit even years of bank statements showing how I saved the money. but on the other hand, whenever I try to explain something it seems to get worse. like me saying she was not working.

noid for medicals should be really simple, I wish this was my case.

Did they ever ask you about medicals before? I can only think the reason for the NOID instead of RFE is for you to reply faster.

@done yes, they sent me the RFE first for medicals, but my form was incomplete and they sent a NOID requesting me a new I-693

ohh, the NOID does make sense then. I submitted my medicals with the application back in 2017, when my i-140 was approved in 2020 they send me an RFE for medicals since the other expired, it is expiring again in August if you count 2 years, but I am not doing it without them asking since I could be denied and spend 1k for nothing.

@done they probably will send you a NOID requesting a new I-693 if the last one expires !

hopefully, I am going crazy about this all. all they asked was a notorized written statement about how we provided for ourselves during the period without work authorization and tax returns. we are debating sending only what they asked vs including bank statements as well.
