EB3 Application with pending asylum case without visa entry(esta entry to US)
Hi, My name is Eugene, from South Korea. I suffered child abuse(my mom came with a knife to the orphanage for money. etc like that). So now I am an asylum applicant, but I have a valid working permit when I arrived US I didn't have a visa. So that is problematic. Could you answer for this one? I served in a choir for months and did many jobs including cleaning the toilet, serving, dishwasher. And now I am studying hard for com sci in college. Please do all advise without hesitation. hi Eugene, u have a work authorization to work and have a pending asylum, which is good. just don’t commit any crime. get an immigration lawyer if u don’t have one to help u out win your case. good luck

you’ll get denied if you apply for eb3 since there isn’t any underlying status such as F1 visa or B1 visa. I have a friend and he got denied immediately. I’m not a lawyer so you should consult with them for best results.

Best thing is to get AP. find an embassy not south Korea willing allow you to do consular processing there and once your date becomes current go for your interview at that embassy. speak with a good immigration lawyer.

your case will be denied since asylum is not a a status like (f1/h1-b) you have to do consular processing because you are not eligible for adjustment is status within US. you can even do consular processing since you applied asylum so going home country for interview is not an option. your only option is scheduling your eb3 interview in any third country except your home country when the time comes.

@Eugene Hong Some people get adjusted using matter of orban, but a good lawyer can do that.

pending asylum to employment based is a denial, unfortunately it's impossible to win this case anymore
