EB2 ROW PD: Dec 2022

Congratulations! I am EB2-1 ROW PD Nov 10, 2024, only for EAD approval and card for my dependent children 4 days back but nothing for myself and my spouse so far. Did you apply with family or you don’t have any dependents?

@Mikey H, thanks for the reply. Just trying to understand......you said that your PD is Dec 2022 but your timeline says i140 PD is Feb 2024. Please can you clarify? Thanks! The reason why I ask is because my PD is alsi Dec 2022.

@BL D, porting or retaining of a priority date is a means where USCIS allows one to use PD from an earlier approved petition for the AOS.

reason for the gap was PERM took a year and 2 months to get approved. as for dependents, no I do not have one.

@Mikey H : Congratulations 🎊 I would love to know, what is EB2-1, is it different from the regular EB2 ? secondly, what was your priority date?

in order to apply for green card there is a pre requisite if the green card is obtained through employment. The requirement is labor certification aka PERM, which is issued by DOL(Department of Labor) not USCIS. Once DOL certifies your labor then you can apply for i140 and i485. but your priority date will be when you applied for labor certification. mine was applied for PERM on Dec 2022. So my PD becomes Dec 2022.

not sure about the difference but mine is regular EB2

I didn’t self petitioned, or it is not EB2- NIW, which lets your skip the labor certification part. which usually takes 2 years now a days

Thanks for sharing. Please my PD is Dec, 2022 and I filled my green card in March 2024 but got rejected where USCIS stated that my PD was not current and there were no visa available. Even though I filled my i-140 in Dec, 2023 and got approved in Jan, 2024. Please why was my application rejected?
