EB2-NIW . AOS I485 - What should I NOT include? What am I missing?

Hi everyone, my EB2-NIW (I-140) was recently approved and I’m preparing my I-485 Adjustment of Status package. I’m so excited and nervous at the same time. This is what I’m planning to include: • I-485 • I-765 • I-131 • I-864W • I-693 (medical exam) • I-140 approval notice • Passport copy • Visa copy • I-94 • Birth certificate + certified translation • 2 passport photos per form Is there anything I’m missing? Do I need to pay separate filing fees for Form I-765 (EAD) and Form I-131 (Advance Parole) when submitting them together with the I-485? Or are they included in the I-485 filing fee? Also, should each form be submitted with a separate form? Also, is there anything I should NOT include in an EB2-NIW I-485 package to avoid confusion or an RFE? Thank you!

well, looks okay... do attach copy of your employment letter and your paystub (if you have). I would recommend writing a cover letter along with your docs. do work on your i485 form especially the checkbox section. if you miss anything there, they will return your form. yes make separate payments for each form. good luck

Hi I recently filed I485. everything looks okay. you can add cover letter, Paystub and employment letter as suggested by Jamal. The form G-28. yes you have to pay separate filing fee for all the forms EAD, Adjustment, advance payroll. I heard these days they don’t accept personal check. Credit card (Form G-1450, if filing by mail) However: Each form’s fee should be paid separately. Best practice: separate checks for each form.

For EB2 NIW, do not include I-864 or I-864W. Employment based self petition cases do not require an affidavit of support, and adding it can create confusion or unnecessary review. Also do not resend your full I-140 evidence package. Just include the I-140 approval notice. Your list is mostly correct. In addition, include copies of all prior I-797 approval notices, proof of maintaining lawful status such as I-20s, DS-2019s, or H-1B approvals if applicable, and copies of any prior EAD cards. Adding Form G-1145 on top is helpful if you want text and email receipt notifications. You now must pay separate filing fees for I-485, I-765, and I-131. They are no longer included together.
