@Amna Sahar, you seem much more confident now. While I was waiting for the Final Action Date (FAD) and Filing Date (FD) to align, I started considering the EB1A category. My FD is now current, but the FAD is still significantly behind. However, since we’ve already moved beyond the filing stage, we decided to set the idea aside. Interestingly, I discovered this year that some individuals who received EB2 approvals started pursuing EB1A. The decision seems to depend heavily on their immigration circumstances, such as whether they’re living within or outside the U.S., their current visa status, and other factors. The waiting period after an I-140 approval for EB2 can often feel more frustrating than the period before the approval.

@ade O well… As I mentioned in my previous message, those are my reasons, and no lawyer has wanted to take my case for EB1a. I’m not an expert on self-petitions and didn’t want to risk it, especially since I used every cent I had to prepare as best as I could the NIW. Additionally, I want to clarify that the perspective on these cases is different. For EB1A, you must prove why you stand out among other professionals in your field ( So a Doctorate a PhD or a Master’s is not just relevant here, This is a MUST!) and demonstrate substantial merit with supporting evidence. The EB1A category focuses on your past accomplishments and why you should be granted this classification. Therefore, regardless of how much evidence we gather, the key is how this evidence can be effectively used for each case, is not that easy as changing from NIW to EB1a, is totally different.

@DesiGirl2010 Chackunny yes this is only i-140 approval with normal processing in nabraska. I am outside USA

I am IOE92379 block in Nebraska Center, in the USA. My I-140 it was submitted on January 5,2024 almost 12 months waiting. I hope to receive approval decision very soon.
