EB2 -> EB1 porting for India is the new scam!
Looking at the EB1 India FAD, it essentially means that the full quota for FY24 is expected to be taken up by people porting applications.

this is caused by EB1-C premium processing. if someone can crack EB1-A or B, they are likely capable and deserve it

eb1c has been scammed big time by Indian companies.. till it’s fixed good luck to eb1a and eb1b India petitioners.

EB1C should be decoupled from Eb1A/B imo

absolutely,!! eb1c is the biggest scam ever. The criteria is so easy to meet, doesn't deserve a spot in the eb1 category. should be more like eb6 category

i wish they had this flow from A-> B -> C visa allocation within EB1 lol

EB1-2 MomoSep 15, 2023
agree!!! EB1C is a scam. here in all our companies they are firing managers or demoting them to individual contributors and most EB1C folks come in as a manager of a team from india.

Folks, previously also I tried to stress the point that if someone has already waited for 10 years or so in one employment category let’s say in EB2 and then the person did something extraordinary achievement like winning Turing Award or got nominated for Nobel etc or invents a new technology that is a game changer, and then files for EB-1A and gets approved , would you want that person to again go back in the queue ? He has already waited for 10 years! Will it be fair to again push the person back in the queue ? Again what I am saying is a hypothetical scenario and if the person achieves something like this down the road. For such scenario porting PD makes sense. I don’t see any unfair thing here. We should go to the root cause of the problem and that is to see if in the future , country quota can be increased if possible and perhaps that would solve some of these backlog issues or ideas like even reusing visas etc

@S SS thumbs up. The visa numbers are fixed for 3 decades. very few people came to US in 70s or 80s. they must increase it if they really want productive labor force. Till now only India, China, Mexico and Philippine suffered . now the row is feeling the heat. let’s see where it goes. everybody cannot marry US citizen and get non quota GC

@S SS I am not talking about eb1a vs. c, but am talking about porting of previous dates. and it’s obviously not possible that 7% of total eb1 quota winning Turing Awards or nominated for Nobel prize!?!?

@Rick S Certainly not, EB1A folks not just include Nobel prize winners or Turing awardees but also Nobel nominated guys, Inventors, researches who worked with other Nobel winners or Turing award winners or worked with Nobel nominated guys or inventors of new technologies, and/or best selling book authors and/or command very high salary which only top 5% of folks command in their field and/or research articles with very high citations and what not… There are I guess a list of criteria and one has to satisfy at least three among them. The examples I gave was to stress that when you make a rule it should be fair to everyone and that’s why I gave a specific example. I was not stressing about A vs B vs C. Certainly not. I was trying to also stress upon the root cause of the problem which is if possible in the future to increase the country quota for all employment categories and also if possible to see if visa reuse is possible.

I worked so hard getting my EB1A approved and these EBIC guys are literally killing us and making our efforts and hard work worthless

Folks, don’t get disheartened. Knowledge never goes waste. It might take a while to get the GC because of the dates but that’s not the end of the road. The knowledge that you have gained and the efforts that you put for several years or even decades so that you could even become eligible to apply for an extra ordinary category would certainly give dividends in your professional career. This is also applicable for folks who unfortunately did not get approved. One should see life in chunks not in bits and pieces. Trust me, we are not alone in this, many very talented folks have been waiting for long. I know highly accomplished folks who either waited or are still waiting to get their GC. Whether such talented people should keep waiting for a GC or move on in life or should have moved on in life rather than spending time to get a GC is certainly debatable.
