EB1A - I485
My I485 case status shows Case Was Sent to Department of State. However I’m in India right now for vacation. and returning to US tomorrow. Can someone explain about this case status?

how long are you in India? did you travel in advance parole?

did you have an advance parole?if not then you are going to have a consular processing instead.

I’m in India for last 3 weeks and returning tomorrow. I have my H1b stamped to travel back. Would the case status change once I enter US?

Is your priority day current? it’s very odd situation for your AOS application move to department of state. did you get your advance parole card?

PD is current. AP or EAD not approved either. I traveled with H1B and got stamped in India. Traveling to US today

I guess traveling without the AP and getting the H1B stamp may have trigerred that move. Did your pending I 485 came up during your H1B visa interview?

not true. I travelled to india on my H1B status while my EB1 was under review without AP or EAD. subsequently everything worked out and received my gc in 2022.

My lawyer had a discussion with USCIS agent and confirmed that USCIS has requested department of state to return the underlying approved I140 petition so that USCIS can process the AOS. This seems to be normal process.
