honestly speaking it’s a bit frustrating for me as well as until the time Mr. Trum was president everything was going faster for EB1 cases all my friends who applied in 2020 got their GC’s within 12 months in the same category

We can keep guessing why they did not pick your case v/s mine v/s your friends, but I guess we will never be able to understand the logic :D

May 2021 Nebraska EB1C All concurrent filing 140, 765, 131, 485. Fingerprint done in June 2021. Medical notification received and submitted in Oct 2021. Still waiting for approval. I see July, Aug and Sept 21 concurrent cases getting approved. But i am waiting for i140 approval and all others. Hope we get it soon.

June 2021 - concurrent filing- no update on my case yet

@Sandy s - correct, USCIS is probably using parabolic pattern for picking cases per every 1000 or so filled to show progress — as my 140 from Sep’21 was approved, but couple of my coworkers are still waiting even applying before me. I know it’s easy to say don’t stress out; but you’ll definitely be hearing the approval message soon, based on the increase of case processing volume. good luck

@Sandy s - Yeah. I hope your RFE isn’t too complex, last year my L1a extn came back with 8pages of questions ;) and they were simply asking for drilled down details about my organization. so should be good.

I guess that ones that are pending have gone for a second level review. Saw RFEs going out for the ones processed in the last 3 days.

@G R not sure if a set of files get RFE - unless the officer in charge has been having a bad day 🤣 @Sandy s don’t worry it should be a simple one. One of my friends got a RFE that he didn’t even needed to do anything - it was all just company’s tax - payments - wage report.

i spoke to uscis representative few days back and was informed that when you file concurrent with medicals all applications are processing together i.e. there is no hold up or wait for one approval to grant the other. To which i asked does that mean i can get 485 approval and card without i140 and the representative said yes that can also happen. i am still thinking how that can happen but thought to share and check if anyone has experienced such a case.

Nope. timelines is a very clear answer basis your pd they check the processing time for center and give the date which is what we see online also. so no different.

@EB when did you file? My biometrics were done june'21 last year after May'21 filing

I contacted the agent and was told to continue to wait for biometrics appointment or notification of reuse ( but he would not tell me if that is the case, and even if that is the case, only my family has their biometrics done during L2 extension) so I would still need to get them 😔

@ C U if USCIS has already taken biometrics in the past for a different purpose, they reapply in some cases. but not sure what circumstances they reapply, it is unclear

if I check the hilites dashboard, it shows a good number of cases +/-500 from my receipt number have not been fingerprinted, so am not alone

strange situation...same type of cases...same filing months...few people got EAD but nothing else...few people got I140 but nothing else ...& few people got Green card.

@Arun K Congrats. @E B Hilites only pulls data dump backed to months data with stages and tie it with current status. it’s a great tool for trends but Doesn’t do help to compare cases - my personal opinion. I’m Sep’21 approved end of Jun, but I’ve a friend waiting since mar’21. I hope yours comes very soon. good luck.

@pp - what's your filing date? i think filing will depend on attorney that what my attorney told me and ideally fees should be taken care of by the employer. But my filing was May'21 and received my i140 approval on Thursday without PP.

my filing was apr 2021...my attorney said..I have to pay filing fees of $2500 & not employer

I would suggest all who applied between March and May 21 shouldn’t go for wasting $2500 for 45 days processing time

from timeline standpoint anything can happen. But if you have i140 approval with EAD and 131 all approved and medical submitted - i think it might be quick and within this year quota of gc approvals.

maybe pp is a sign that now uscis will slow down processing for remaining petitions

i have seen multiple cases for which 765 131 is done before or after i140 so it seems to vary all the time and no idea on the rationale on it. Mine got done with 765, 131 and then 140.

Hanif - nice suggestion...however tough call to go for premium processing or blindly wait....as normal processing will be even slower now ...so God knows 17 months is still valid

it is regular processing not PP. So far I have recd EAD & I140. Looking forward if someone knows how much time it takes from here till Green Card

Congrats PP. Is your 485 transferred or still in Texas? That could be a sign. I guess wait for medicals RFE (unless you have already submitted), and then its only a matter of days

I have already submitted medical at the time of concurrent filing in Apr 2021. My 485 is still with Texas.

Sept 2020 filer, i-140 RFE received in Apr 2022…TSC hopelessness….

Sept 2020, RFE received only in Apr 2022, replied with premium processing under EB1C…another $2.5 grand on top of all the visa extensions…they have found a good cash cow

131 approval separate from 140. 765 approval came first followed by 131 and later 140. all approval approx..after 430+ days. Waiting for 485 approval now and checking if they have to transfer to NBC for approval or can Nebraska do it?
