EAD extension - pending i485
I’m currently outside of processing for i485 however I’m now in processing for another i765 (at least) for 10mths waiting for official approval of a new EAD. I have been given conditional 180 days to work… honestly I dont know how they can communicate receipt of i765 extension but cannot respond to the i485 status adjustment… I’m doing more work needed, when a green card could have been considered for approval last august!
but as stated in a previous post of mine, uscis and a congressional inquiry has proved unresponsive and unreasonable delay is horrendous therefore considering filing of a mandamus case!
Resource: if congressional inquiry doesn’t work, have your attorney (your attorney can only inquire because they have to be of membership)…. contact AILA (American Immigration Legal Association) and ASISTA…. before considering a costly mandamus… exhaust all options. WE ARE ALL HERE TO HELP!!! if you have resources share them with the community, we are all experiencing unreasonable let downs by uscis, we got to try everything!

@Grace OfGod I have not had a i485 interview for adjustment of status (green card). I’m outside of processing deadlines without response and still waiting to be called for interview
My i360- vawa visa was approved in June 2022… over 19 months ago.
I had to renew my EAD because it expires next month. it was extended 6wks ago for 180days conditional pending green card interview

Please people never lose hope. Fight for your rights. You can sue USCIS for delay on your own, if you cannot afford an attorney, my friend did it for his delayed case, and got papers within 45 days. Do youtube search to learn more about it "writ of mandamus pro se"

I have already done that… no response to me (I inquired myself with my attorney muted on a three-way)…. they followed up with, a denial to talk, even though I passed the test questions as the petitioner for my identity… all because the G28 form (attorney representation) had not been updated… the G28 update was sent in (June 2023) and we received notice in the mail (July 2023) but uscis did not update their system resulting in cutting us off from inquiry on the 22nd November 2023.
proof of receipt and filing of updating attorney rep was handed to congressional inquiry (dec 5th 2023) - they said the same thing but questioned uscis system when proof was provided, because they noticed my case file hadn’t been updated.
my case online shows no update on anything (i485) since oct 2022.
Believe me, I’m doing everything correctly, uscis is failing their job 🤷♀️
what gets me is that they can approve an EAD extension but not look at my i485 which would avoid all problems altogether. Only logic!

@kat . File a Mandamus Lawsuit. This will force them to make a decision.

@A T mandamus is already on the table for consideration… just trying two external organizations first for response first before moving on it
