EAD approved, can it be used?
l’m currently on L1A visa with my spouse working on L2 EAD. I had a concurrent filing of my EB1-3 case, with EAD/AP approved, but I-140 still in progress. My L1-A extension is coming up and I plan to go it, considering my I-140 yet to be approved. Can anyone confirm, if my spouse can continue to work using the EAD/AP which has been approved, though it is not based on the L2 document?

just to clarify, you will both be using the AOS EAD?

with I-140 not approved, I wasn’t planning on moving to using EAD. was going to continue using L1a until I140 approval.

yes they can, but if the i140 gets denied they will be out of status and will need to apply for the L2 Ead I think

basically they are no longer L2 status at the point of using the AOS EAD I believe so it’s all ok unless the i140 gets denied

Always better to have VISA. please go ahead and apply for your extension. If at all if there is any issue with your I140 then you will go out of state..

that would make sense. yes. I plan to apply for L2extension as well along with mine. but even after L2 approval, if I apply for a L2 EAD to be on safer side, I’m not clear how they would extend the L2 EAD. since it is the same # for both

I received a letter last week from USCIS that L2 visa holder can work with valid I-94 and a copy of the letter. my wife doesn’t have EAD.
