there's no need to pay for a driver's license that will expired in 2 weeks. they will only give you one that will expire on Dec 1 so that make no sense to me

Rocco is right about the laws in NC. unless you have paperwork that extends your stay to a different date, NC won't extend your DL past the date on your current papers. FL is the same too. I have done my DL's in those two states in the past and NC was actually more troublesome because I had to explain to them that either their system is wrong when it comes to the I-797, or they're interpreting their system the wrong way. when using the i-797, they use the extension from the receipt date rather than what the I-797 says, extension from expiration date of current card. so if you find yourself in that situation, fight them on this. anyways, NC is weird. but that's besides the point. MR - NC can't do anything if you don't have any paperwork that extends your legal presence. 😶

MR - I'm not sure how NC is going to treat this, so, I would recommend you walk in, and see with them. if the I-797 is approval of the EAD, then they might give you 1 year if they operate like FL, and they will tell you to come back with the EAD card so they extend to the expiration date of the EAD card. if the I-797 is just acceptance of your petition for an EAD, they might give you 6 months, or wait until you get at least an I-797 approval. I know in the past FL would not give anything with just an I-797 acceptance. NC gave me an extension recently with the I-797 acceptance. but this is different because that was a renewal of my EAD, and I'm under a category that gets automatic 180-day extension. so, walk in to the DMV to hear what they say. 🙂

M R - does your I-797 notice says anything about your presence? any extension? if so then NC will use it to extend your DL. if not then you will have to wait for the i-797 approval notice.

in Virginia, I used my I 797 notice to get an extension for my driver's license for a year. Just go give it a try with your I 797 notice
