I am an EB-3 applicant with a priority date of September 21, 2023, and my I-140 petition has already been approved. However, in December I was falsely accused in a human-trafficking case. A cricket team invited me to Malaysia to play for them, and I accepted their invitation. During the trip, the team appointed me as the manager because I was a senior player, and they asked me to sign an undertaking stating that all players would return to Bangladesh after the match. Unfortunately, several players did not return. Because of this, the Bangladesh immigration authorities filed a human-trafficking case against me as the person who signed the undertaking. I am currently attending court hearings regularly. The charge sheet clearly states that I traveled as a player and that I was forced to sign the undertaking. The investigation report also confirms these facts and shows that I had no involvement in any trafficking activity. My I-140 was approved on December 4, 2025, but the criminal case is still pending in court. My lawyer and I are confident that I will eventually be cleared of all false allegations. My question is: Since the case is still pending, what should I do regarding my U.S. immigration process? I can obtain a police clearance certificate with permission from the honorable court. Should I submit all required documents now for DQ, or should I wait until the court case is fully resolved? Thanks in advance 🙏
