Do you think I qualify for the visa HB-2 NIW?
Two and a half years ago, I arrived in the United States on a tourist visa, and after two months, I applied for political asylum. In my home country, besides being an entrepreneur, I was involved in political activism. None of the lawyers presented me with options other than applying for asylum. Recently, I learned that an acquaintance from my city obtained residency through the EB-2 NIW program due to his entrepreneurial background. I have over 10 years of experience in creating various successful businesses in my home country. I completed my law degree in 2013 but focused entirely on entrepreneurship. Do you think I might qualify?

@Ronald Paz you need to define your case by providing a clear explanation why your stay in the USA is beneficial to the country. For example, you can claim that your companies are creating jobs for Americans.
Being an entrepreneur isn’t enough. You need to bring evidence that your endeavors are successful and your unique knowledge can bring benefits to 🇺🇸 .
I suggest you to check O1 visa criteria and see if you have at least 3 of those.
You should also talk to a lawyer experiencing in EB2 path.

You need to talk to a lawyer especially because of the asylum case. Concerning NIW and entrepreneurship, talk to McBean law as she presented a couple of those cases on their YouTube channel in the past year. Best

I’m on EB2 NIW. you need an advanced degree (master/PhD) for this path. Also need to demonstrate exemplary achievement meeting at least 3 of 8 criteria’s and a plan to continue to grow in the US.
