Derivative
Greetings to Everyone!
My son as derivative, who was 15 y.o when my VAWA case was filed in 2023 now he is 20 y.o.. Will he be still my derivative even if he will pass 21 when my vawa or i485 be approved?
Is anyone on the same boat?

yeah, you should. the age of your derivative stops when you submit the application. until itβs adjudicated, it will still be 15 yo. i am not an attorney but i read books and immigration laws.

yes, thanks to the CSPA.
the age got frozen when you submitted the Vawa petition.
you can look up CSPA to learn more about it and feel more confident βΊοΈ

I was worried about the same thing but my lawyer confirmed that my daughter will be fine once she remains unmarried
