dependent forms stuck I -485/I-131/I-765
Hi all,
Looking for suggestions or insight. My I-485 (as primary applicant) was approved over a month ago (via EB1-C), along with my daughter's. But my wife's case is still pending, even though we all filed together (I-485, I-131, and I-765) with a receipt date back in August 2024.
My daughter and I received our EADs and Advance Parole pretty quickly, but my wife's are still pending. She did get an RFE for a missing original birth certificate, which our lawyers responded to, and USCIS acknowledged receipt. Since then—radio silence. The only reasons I could think that may affect her case, is that my wife is dual citizen with Iran/Canada, so background checks may take longer due to Iran. She also had her B1/F1 student visa refused long time back (over 7 years ago), which we mentioned in the I-485, but still shouldn't even affect the I-131/I-765 forms..
I’ve tried contacting USCIS via Emma, phone, and even requested Tier 2 support a few weeks ago, but haven’t heard anything back.
Has anyone experienced something similar or have any advice on what else I can do? It feels like her case might be stuck. I've seen other posts where dependents got approved between few days to few months, but have not seen many cases where all the forms seem to be stuck.
Field office: San Jose, CA
Thanks!

@Al Ce I think your wife’s I-765 is outside normal processing time. You have a legitimate reason to ask your congressman/senator’s help.

@Al Ce I’ve seen few datapoints where I-765 was significantly delayed. I think they told that it was due to background delay. Even I-765 needs to go through background check.

@K L thanks for the suggestions, do you know which route may be better to go if Congress man or Senator? we live in the Bay Areas, CA

@Al Ce I think you can try 2 senators and 1 congressman at the same time. I also live in the Bay Area. In our experience, CA senator Alex Padilla’s office was the most responsive.

sorry about that. the Iran profile definitely commands a long processing time.
