After 2 yrs and reaching out to my congressman office, we finally got a response but not a pleasant.
USCIS has decided to use our previous denied I130 when we have an approved I130 which we had constantly called about, but the representatives always said to not worry the approved I130 was linked to the I485 now they're saying he has been in the country unlawful.
any advise please? Motion to reapply doesn't guarantee his stay nor would he be able to work and if we re-file we don't know how long we'll have to wait again.

first thing get a lawyer! this sounds way to messy for you to be fixing on your own.
also go to foia.gov and request his record this will show u everything that uscis see so you might be able to see something thats “outstanding” as well as why did they denied you.
Dont reapply but put in a motion to reconsider or reopen. reach out to your senators too . good luck to you hopefully you journey ends soon with respons you ve been waiting for 🍀 🙏🏻

thank you @Omega % but he didn't enter unlawfully. he has been in the country legally for over 5+ years now. we reached out to lawyers they advised us to file a motion to reconsider

what was his status to be considered unlawful? did he apply to asylum? did he overstay his visa?

they used a past denied i130 when we have an approved one already
