all i can say is stay calm and wait for the letter. i know its easy to say but all i could say is just don’t jump to conclusion without looking at the letter. most of the time uscis will tell you on waht to do. you will have options for moton and mandamus. stay strong even if it feels like its the end! ❤️

@sharmeen - im so so sorry to hear that I think we all will in same boat in few days or few weeks from KC it is so unfair and novody’s helping especially bdv. may i ask who is the primary applicant in your case? who was the officer was it the woman everyone talked about blatantly denying cases

It could be something from your lastest Rfe's response. Contact your lawyer ASAP to see the denied letter :)

@sharmeen moona so sorry to hear this. Please contact BDV and Envoy. They should be able to atleast reopen the case. You said earlier that your RFE response was delayed by FedEx, did it reach on time?

don’t depend on bdv or envoy. please hire a good professional lawyers who can fight your case

@sharmeen moona in current situation definitely start searching asap. Consult your case with different attorneys and then decide your next step. Good attorneys might be little expensive but please don’t compromise in this situation. best of luck

@mo kh it’s a law firm that BDV uses. I think newer cases are not being handled by Envoy anymore

@sharmeen moona talk with BDV they will help you through, I think they have very strong team that take care of people getting denied. I would suggest not to cut tie with BDV and hire a different lawyer, I think it’s not envoy that will help you I think BDV has different team that handle this

as you previously commented you sent rfe about medical on your own and envoy sent the other documents related to employer. USCIS got two seperate delivery on their rfes on different time and did not assemble them as one so they likely assumed you did not sent the complete requested documents and denied your case. you should have sent both documents at once. If both documents were received by USCIS on time, USCIS will reopen and have to approve it eventually. your lawyer is able to solve this easily. dont get stressed, everything will be fine.

is there such cases that are denied then appealed to win?

@Cool Dude medical rfe was two years ago. this rfe was new but yes as it was not being delivered for three days where online it said the office was open but delivery attempts failed, second package was sent out and both the packages were eventually delivered.

@sharmeen moona I also think this is about delivery issue, they probably didn't receive it within the allowed window or something like that. But I think it will be resolved without further problem. Keep us posted please

late delivery of your medical rfe seems the reason and it should not be a big issue when handled by the attorney. i have read about sunch a case where the petition was approved eventually.

@Cool Dude we submitted on time and although it was valid by few months, we submitted another medical in November during our interview.

@F M tbh I don't know how to check it with emma, she usually gives me some random info and doesn't answer the actual questions. What question do you ask to get a proper answer?

@F M still KC may be because they dont want to actually approve and make us suffer as they are outright denying cases even though we worked and are working people who did not work got the GC and we are the guinea pig now

Hey guys, finally my anxiety is under control so - here are the reasons we were denied. We ported after talking to bdv. worked full time for new employer past three years. some of the reasons: 1. we did not provide evidence that we made substantial effort to work for original employer after ead was approved-they never asked how many times we tried. this was an assumption on their part. 2. same as 1. also said we used bdv only for AOS purpose and intention was not to work. -we worked almost 3 years. 3. we moved ourselves to find new employment instead of taking help from bdv- false as bdv helped with porting and even with relocation. 4. working in food service while holding a masters in computer science- foreign degree 5. entered usa on b2 inspite of spouse already being on f1- he had no intention to stay 6. family lives in houston but he moved to kansas. so again no intention to stay. - i the dependent was working on site in houston so we decided to move later. we filed for motion. now lets see what God has in store. good luck everyone.

@N S. they mentioned we can not appeal. can people file mandamus after a case is denied? i thought it is only while it is still in process.
