CRP while PD is current (expedited case)
Hi All. I expedited my I485 case and it got approved in December. In Jan, they both approved my AP&EAD.
As of Feb 1, I am current but case status is "CRP due to unavailable visa". I called USCIS a few times and all agents say that "no action need to be taken, just wait"...
Considering my expedited case due to medical urgency, how can I make sure that officer reviewed my case? Is there any alternative way?
Although they approved my EAD&AP, I cannot leave country for medical urgency because I am F1 CPT visa. If I leave, going back to US with AP on F1 visa will be tricky. I don't want to take a risk...But my medical condition gets worse as long as process takes time :( So stucked!.

+1 you can’t do anything buddy , use AP travel out of country and come back no issues

@D P that is not true! he will lose his status F1. however with AP he should be able to come back in. i traveled on my AP twice without any issues. they may due process you at the border ask you some questions but they let me in. as i said you’ll lose your F1 status but you can come
back legally and your status would be pending 485 from there.

@M F what if I give up F1 and accept GC EAD to work but later get rejected from I485? what could be better back up plan? i know I cannot go back to F1.

if you use your AP you would lose your F1 but in your case you are almost done. For me i took the risk and gave up my F1 and started working for my sponsor after I received my EAD

hey @J A , are you still waiting for GC? did you receive RFE? One of my concerns is to receive RFE on CPT Day 1 after giving up F1.
J AFeb 7, 2024
i never received any RFE. Yes i am still waiting for GC as I made a calculated risk based on my PD

gotcha. did you give up OPT or CPT?
J AFeb 7, 2024
i gave up cpt after 1 semester then received my EAD based on adjustment. If you are lucky and your employer is supportive most probably your adjustment would be smooth sailing. It is a risk and it is really up to you to decide whether to use AP but in my opinion there is no need to continue your CPT and start working for your employer.

@J A I let my eployer about GC based EAD and they accepted it. Now I am talking to university that they can recognize my EAD. They hesitate that being "statusless" is not possible, better to keep your F1. i explained but it seems they are not familiar with the process. so as steps, what did you do first?: 1) send them EAD and ask for recognition or 2) just withdraw
J AFeb 10, 2024
i just withdraw
J AFeb 10, 2024
yes its correct thats it is a risk but its your call. If you have the money to pay as an intl student then go continue if not then decide if your case is strong withdraw from school and work on your employer. Even though you are current it does not mean you get to have your GC. I was current for almost a year but never got a GC until retrogression came.
