Criminal Record
Hi everyone, I had some questions I was hoping maybe some of you may know the answers too.
Quick background: My husband lived in the US from ages 6-23. Before his father was deported his family left willingly. My husband has one DUI because he could not serve 200 hours of community service due to the fear of losing his full time job, he chose jail for one week. We are doing a spousal visa. (No need to say anything negative about the DUI, multiple lawyers have stated one DUI with no aggravation, and no alcoholism is not a problem AT ALL.)
1. My husband is currently filling out his DS-260, he is going to of course say he has a dui record, but since we are living in Mexico we are unable to obtain his criminal record from our hometown in Illinois. Where do we go from here?
2. Must you upload your criminal record with your DS-260 or can you just say in the additional information section that you were unable to obtain them due to your not being in the US?

for any kind of criminal record they probably will ask you for i-601 or i-601a waiver 100% my dad got rejected for visa and was told to do 601a waiver, evethough his ban and charges were removed

@p I’m actually trying to find out if I have to upload my husbands criminal record (DUI) or not because we live in Mexico right now and he cant go to the US to get his record since he doesn’t have his visa. :(

but I looked into foia! thanks! are we able to do that if we’re living in mexico? or does this mean I have to go home to illinois in order to get my husbands record. (the only reason I don’t want to is money and I’m a stay at home mom and traveling with my one year old is rough)

I think you can still get the records. If you call the clerks office of that county in USA and give them your case no.(usually it is on the warrant which they serve you before you go to jail). You can ask them for disposition of charges and some offices can either Fax or mail. If they can Fax it then its good. And if not than you can ask them to mail it to any of your relatives US address and then ask that relative to mail you in Mexico. Just a suggestion. I hope it helps.

You can request it online to the court that was responsible for his case. I have recently requested some dispositions for myself and they sent it all online (including the court stamp)

you only have to pay for the docs it will probably be less than $ 10
