CR-1 Case Returned to USCIS After 221(g): Is B2 Visit Visa Advisable?
My spouse filed Form I-130 for me in March 2021. The I-130 was approved in June 2023 and later processed through Form I-824, which was approved in June 2024. The case moved to NVC in July 2024, and my immigrant visa interview was scheduled at the Mumbai Consulate in November 2024. During the interview, I was issued a 221(g) and asked to submit my divorce decree. I obtained the decree through court and submitted it in March 2025. After this, my case was placed under administrative processing and later returned to USCIS for further review. There has been no update for several months.
Question:
Given this situation, would it be advisable to apply for a B2 (visitor) visa to visit my U.S. citizen spouse while the immigrant visa case is pending? #USImmigration

@Waiting Long will it affect my ongoing visa? if I applied

@Shraddha Makwana I know it’s stressful to wait , since you already submitted the documents for the imigrant visa your tourist visa won’t be approved and will cause confusion for the USCIS , especially during this times you don’t want to complicate things.

@Shraddha Makwana I don't believe it would be approved, mostly because of "ties to your home country " You are trying to live here and that shows lack of ties to actually go back. I doubt it would affect anything, mainly because it didn't affect ours, but was denied for reason that I stated. you can try, but you don't get money back if denied. "Not legal advice "
