Confusion about F1 and EAD
Hello guys,
I’m an F1 student and using EAD to work for my sponsor. My attorney said that I’ll just need to notify my school with that. I did and they responded as below. Do they mean I can maintain my F1 status and using my EAD to work at the same time? Also, why is it a violation because as far as I know, F1 status will be terminated as soon as EAD is used. I’m so confused. My I-485 is still pending btw.
“Thank you for providing us with a copy of your EAD card. After further evaluation, it appears that your I-20 is ending on May 20, 2023. You have a 60-day grace period from the end date of your I-20 to take action on your record. If your change of status has not been approved and you do not register for full-time, your record will be terminated for the violation (failure to enroll). Please contact your immigration lawyer to discuss any possible implications to the termination of your F-1 status.
If you would like to maintain your status and continue with school, you may submit a Change of Educational level request form with new financials and letter of guarantee (if you're being sponsored).”

just notify the school and they will not update your I20. I did that, it’s simple and you will pay less

You can use your Ead card. If you want to maintain your F1 status, you should be full time student while you’re working full time.

đi làm khai thuế thì F1 tự hết thôi. Nếu muốn học và làm thì vẫn được, nhưng hình như học phí sẽ giống như công dân ở đây, không còn là sinh viên quốc tế nữa.

I asked the same to my attorney and she told me that the Ead card won’t give you status, so if you want to maintain a lawful status while waiting for your I-485 you should continue to be enrolled full time with your school

according to my attorney,
they have told me to use the general guidance that GIA (outside counsel) provides about dropping F-1 status. And the following statement is guidance from the attorney:
"If you have been attending classes and have not started working yet, you are considered in F-1 status. Using your I-485-based EAD card to work is generally considered a violation of your nonimmigrant status, therefore once you start working you will no longer be considered an F-1. Please also note that a pending I-485 grants you a period of authorized stay in the US until the I-485 is adjudicated. Since your I-140 is already approved, and I-485 is receipted and pending, it should be now safe for you to drop out of school."

some of y’all said I can maintain my status, some say I don’t. It even makes me more confused. I just want to play it safe 😞

once u use ur i485 EAD (not OPT EAD), u will definitely lose ur F1 status. I don't know why these guys are saying confusing stuff, but just know its 100% clear that u can't maintain f1 status while using ur i485 EAD to work for ur sponsor or any other job.

@Van N we are not trying to confuse you, it’s just what the attorney says in every case, I understand the frustration, if I were you I would just go to my attorney, that way you would have a professional with way more knowledge guiding you.
