They should apply under C09 for the first time. C31 is received once your VAWA is approved. Under C09, you can get your work permit while you are still waiting for your VAWA approval. I don’t think they can apply under C09 now because this option is included in your Vawa form.

If your the spouse of a US Citizen you can still apply for EAD under C09

yea my ex- wife is us citizens, because my that case is denied ( marriage ) they told that we can't apply for c09, we can just apply for c31 under vawa

@approved blessings your lawyer doesnt know what he’s doing and his info is totally wrong. no matter what case is denied, you can still apply for C09. if you go with C31 then be prepared to wait 3 years without being able to work. but if you can’t wait then apply for C09 now and get your work permit and start making money while you way for your vawa approval and leave everything to God to the best on your case that way your mind will be at peace and relaxed.

@approved blessings Your lawyer is wrong. You need to apply for EAD C09 now so you can be able to work. C31 can only be issued upon VAWA approval which takes about 3 years or more. Since your ex-wife is a US citizen and you have I-485 pending, please file EAD C09 so you can be able to work while your VAWA is pending.

get your refund from your lawyer is incompetent. just get your money back as I did from my st…d lawyer. she gave my money back.

pls apply for C09 So you can work. it doesn't stop your vawa case . when your vawa is approved that's when you will be given C31 automatically . please be on it .

you need to file that c09 or you won't get your work permit in the next 3 years once vawa is approved. Mine did the same too and I hired another lawyer and got my co9 approved.
