Concurrent Filing was approved today!
F2A, we did concurrent filing in 2021/10, the case was processed at NBC, FO is Chicago. We just received the status update yesterday saying “The case is being actively reviewed by USCIS”. and today we got both 130/485 approved at the same time. Very grateful. We should have sent ALL materials to be well prepared and it turned out to be what we expected: marriage certificate, joint Bank accounts, family photos, baby birth certificate;-) …. most importantly, and I-693 form! I would say for those who filed the concurrent filing and waited for 15 months or so, you probably will hear a decision very soon. according to my past inquiries, USCIS said that a 12-15 months processing time is pretty normal. Be patient folks, the best is yet to come, and wish you all good luck! Congratulations. The same thing happen to me yesterday, i130 actively reviewed then after a few hours both were approved with no interview as well. and also F2A category. just that my PD was Mar. 14 , 2022. almost 10 mos. I got My AP and EAD both on June 2022

@Meedo Ben , if you haven’t filed your 485 yet, you probably will be asked to provide the physical exam per 693 form instructions prior to the interview (if any), simply attach it to your ready-to-file 485 form and send them together to USCIS NBC(or your case processing center) once your 130 is approved. However if you did concurrent filing for both 130/485 but haven’t sent them the 693 form yet, you could always send it as supplementary to your I-485 form. remember, the 693 form is triggered by I-485 process, it has nothing to do with your pending I-130 approval.

@Meedo Ben, I would like to add. You could file with I-485 concurrently, however, please remember I-693 Medical Examination has a validation period of 2 years and has to be received by the USCIS within 60 days from the date the surgeon signs and seals the envelope that contains the form. (And it has to remain sealed when the USCIS get it whether you submit concurrently, mail it for RFE, or bring with you to the interview.) Good luck!

@SS Lee, congratulations. I’m F2A aswell. I didn’t include Medicals when I filed concurrently cos my lawyers asked me not to. and I regret not including it. but anyways, I got a deficiency letter from the a couple months ago but haven’t gotten RFE to submit the medicals. An agent told me my interview had been waived but I’m still waiting to see what’s next

@roxy Dee Thanks! I saw your PD and I am guessing your case will likely to hear an update around March or so. We didn’t hire attorney as we felt it should be straightforward unless USCIS questions for RFE. My wife entered to the states in B2 visa for fear that the offshore processing would double the time vs in states. And we felt very lucky that USCIS didn’t ask for more. To some extent, I found a lot of immigration attorneys are nothing better but form fillers, they showed little empathy or do not well understand your concerns based on my previous EB2 application, so, trust in your intuition, and provide adequate evidence to defend your case as necessary, sometimes for USCIS you would find “less isn’t more”. ;-) Wish you all good luck!

@roxy Dee the reason your lawyer asked you to wait was most likely because the medical examination has an expiration date. From the date your surgeon signs and seals the envelope with the signed form in it, you have 60 days to mail out to the USCIS, and they have to receive it within the 60 day timeframe as well for it to be valid. From there on, it’s good for two years. Thus from what I learned, I don’t think the form I-693 medical examination is the main factor for their decision, at least not until they receive it and see something questionable. I know some people have waited for more than two years when the USCIS has finally gotten to their case, and if they submitted the medical examination concurrently that it went past the 2 year period, it’s very likely they will be asked to redo the examination which is a few hundreds that they have to pay again. I’m not sure why most attorneys don’t mention that to their clients so they wouldn’t panic about it. I filed the applications myself and read through all the instructions, it’s all in there, but before that, I kept wondering the reason why is it that you can file later if it is a requirement for the application, but they don’t need it right away and when will be the good time? I still filed it concurrently, but knowing the reason I’m more confident what will happen next. I think good attorneys should at least do the same for their clients, so most of us don’t have to pay them but still get on here trying to find out answer from others, that would mean they’re not doing their job. If we’re only paying for them to fill out forms, they should be called filing agency, not immigration attorney. No offense to anyone’s attorney who’s doing a great job, just saying after seeing so many people come up here worrying and not getting their questions answered even though they’re supposed to have a professional to help them have a peace of mind. After all, that’s what people paying the attorney to help for, right?! 😉

@SS Lee I read your last comments after writing mine and I agree with you! I have been wondering what are these attorneys even being paid for that so many people are still struggling and some even are trying to patch up the damage their attorney has caused! Ridiculous!
