Concurrent filing
Can one file a new marriage based Green Card while a I-290B (motion to appeal) is being processed for a denied i360?
Idea is to keep my current EAD as active as possible till the new one (with new marriage based Gc) is approved, and then I can maybe withdraw old I485 and I290B ?
for reference, I am beyond the 2 year threshold
to re-apply for VAWA

be aware that you can’t be married if your VAWA is not approved yet

@user 124 As far as I know, if you get re-married, your vawa-based i290B and underlying i485 AOS and its ancillary benefits (EAD and AP-both i360 vawa based) will be revoked/cancelled. And if you start over with new marriage-based i485, i130, i765, i131, this time uscis gonna get harder on your new marriage case. Unfortunately, either way, things get squared.

i understand, but as it stands my VAWA is denied. filing for I290B is just asking USCIS to recosider the decision and re-open the case (which takes time to process) but there is nothing stopping from getting married again

@user 124 Of course, nothing stops u getting re-married. But getting re-married will simply cause your pending i290B (vawa based) null and void--in simple words, it becomes meaningless to consider your i290B appeal.

@user 124 If you both are in real and bonafide relation, love each other, and wanted to start a new life---go ahead, get married instead of wasting time and putting yourself in limbo and uncertainty waiting for i290B decision.
It’s uscis-where hopes get stuck in a never-ending queue, anxiety kicks in, and hair turns gray.
