Compelling Circumstances for EADS
Update:
USCIS just updated a guideline for EADs on "compelling circumstances."
To qualify, you must meet these 7 requirements:
1. You need an approved EB-1/2/3 I-140
2. You'rinvalidid E-3/H-1B/H-1B1/O-1/L-1 status
3. You haven't filed an I-485
4. You're in a green card backlog
5. You provide biometrics
6. No felony conviction (1 misdemeanor ok)
7. You show compelling circumstances
Compelling circumstances" are not defined but a non-exhaustive list is provided.
However, EB-4 Certain Religious Workers (approved I-360) does not qualify despite being a bonafide EB category and suffering a 5-year retrogression.

For #4, does it apply to anyone with priority date 2017? (can someone help me understand what gc backlog exactly means)
