close asylum
Hi everyone,
Please help me out. My I131 got denied because my asylum case was in immigration court (removal proceedings). I had 2 attorneys. One for my asylum who did apply for my termination of asylum(court and DHS-joint motion) based on my Prima Facie and Pending I360. Another Attorney who applied my I360, says that I have to apply Prosecutional Discretion PD. Only then I will be eligible for applying I131 in the future. He says termination of asylum wouldn’t work. I am very confused and worried.
Please help!

@Ram B close your case and dismiss case are two different things. if you close your case that means it’s still pending and you cannot travel. the court just case take your case from the calendar until your are qualified for another benefit.
if you dismiss your case . then you can travel and you no longer have anything to do with the courts and you may be qualified to apply for adjustment of status . I hope this will help and this is not a legal advice as I am not a lawyer. my opinion because I also in the same situation with you

I tried to dismiss my case but DHS did not agree to that and they offered to close the case . now I’m waiting for Vawa to be approve so I can’t dismiss the case

my understanding for PD is to ask DHS for either dismissal or closure of your case . So yes I applied for PD for dismissal but offered case administratively close

@hope waiting they dismissed mine does it mean i will get AD. because they denied two time while my asylum pending and i had PD

@Lovepreet jan 2023 like I said earlier this is not a legal advice but if your case if dismiss from the court then you can apply for adjustment if your have a benefit for adjustment
