Immigration Process

Hi all,

I have an question regarding H1B stamping which I am asking in behalf of my friend. He got H1B approved in 2022 and since then he hasn’t left country. Now he wants to go and get H1B stamping done from home 
country. 

There is a little concern regarding his stamping- His dad is here in US on a B1/B2 visa and have overstayed here didn’t leave the country. 

1. does h1b stamping gets impacted in any way? i mean can there be issues while he goes for stamping? 
2. in ds-160 visa form how to handle this question which asks if your father or mother is in US? 

if someone can provide insights on this would be helpful and greatly appreciated.
