A DUI within the last two years does not automatically bar naturalization, but it is a serious factor in how USCIS evaluates good moral character during the statutory period (typically 3 or 5 years). A single DUI without aggravating factors may still allow approval, but recent conduct is weighed heavily, and USCIS will look closely at the full circumstances, including any aggravating elements, compliance with court requirements, and evidence of rehabilitation. From a practical standpoint, filing while the DUI is recent can increase the risk of delay or denial. In many cases, it is safer to wait until you can show a longer period of compliance and stability. If you do proceed, you must fully disclose the incident and be prepared to provide certified court records and proof that all conditions were satisfied. You should really speak with an experienced immigration attorney before filing to make sure all aspects of your case are properly evaluated. Getting that guidance upfront can help assess timing, address any risks, and present the case in the strongest possible way. - Attorney Rami Lee (All information shared here is for general educational purposes only.
