Citizen step dad applying green card for step son!!!
Hi all! I am wondering how long does it normally take when Citizen step dad applying green card for his step son that is over 18. Not married yet and he is in the US with no status now. My friend need some advice on his case! Anyone with similar case?? Thanks in advance!! How old is the son? Also you could get the info and receipt number for the first application (if still being reviewed) and raise a service request for outside normal processing time, instead of having to apply again…

They said they applied when the son just turned 18 so his younger brother got green card but not him. But I think this is weird cuz taking so long

Definitely weird, since they applied when he was 18 his age freezes and he still 18 for the uscis. What I suggest is to first check the status of the application and if there is still on going, meaning if there is nothing that says “case closed” get the receipt number and fill out the case outside processing times, also call uscis say “info pass” and talk with a live agent about it. The thing they might do is request a rfe for all the documents that is expired and even request a new biometrics since it’s been so long but that’s better than applying again. Hmm I seee!! So eventho he is 25 now he is 18 on his application that he applied already? right? I'll let them know to double check on his current case!! Thank you so much!!

Yes, unless they decide to reapply then he will be on the category of child of a usc over 21. which will take way longer than if his parents use the first application when he was 18

@GC approved, Hi I have one more question! So my friend told me that when his parents applied his green card he was already 18 yrs old and he had expired tourist visa. So because of this sitiation USISS said he is not eligble for this 485. Is this true??

Hi! I don’t think this is true. My sister for example has the same case (18 years old and expired tourist visa) and we were able to apply just fine. The case would change if they decide to reapply, since he is over 21 now his category will change and the processing time for his GC would take longer. My advice is to try to gather the receipt numbers and verify if the previous case still “being reviewed” and raise a service request to move things around regarding this case. Basically applying again will start things all over and when the person is over 21 it usually takes way longer for them to be approved. You can also call them and try to expedite since his brother already have de GC. It depends on how is the previous case status (if still on going or if case it closed and he was denied) I know cases where the lawyer said the kid wouldn’t get the CG because of age, which it wasn’t true and they end up not apply and losing the opportunity because of that. Thank you so much for your kindness and help. So he already got a letter saying he is not elgible for I-130 from his citizen step dad in 2014. So I am assuming his case is something like closed or on hold. I really think his case sould be approved because of his age and other cases like your sisters were approved.. I am confused 😢

of course! my pleasure! what you said is something weird but the best way would be to call them and verify because the case can be reopened too which is a good sign.
