charged $1020 Toronto preclearance
I have a 5 year combo card under VAWA/i485 and we are supposed to be exempt from the fee and CBP charged me anyways at Toronto pre-clearance and said they will charge $1020 every time I ask for parole back. they said under 245 in their system it’s not checked “yes” and they processed me as if I was TPS, DACA or PIP. they didn’t care about my pending 485 nor did they research the expansions. they said that’s just how they are doing it and his supervisor told him to charge me. they asked me about the abuse and photo copied the TPO I have. they told me to apply for a refund and dispute it on my own with no direction on who to contact to do so. they said if I can show they refunded me then they will update it if I have to be processed again at Toronto. update:March 19 after escalating through a complaint, receiving a doubled down response that that is how they were processing VAWA, I.e carved out of the exception with DACA and other categories. I responded about the legal discrepancies in their interpretation of the statute and said I would be escalating to all oversights, including congress via my senator and the Ombudsman. 7 emails to different parts of the agency such as DHS trip and civil liberties but not having to escalate to senate, I received an email from the YYZ port yesterday that said the following: Dear Ms A higher-level review was conducted internally, and we agree with your position. As such, we will be processing a refund of your parole fee in the amount of $1020. The typical timeframe for a refund will be 2-4 weeks and will be credited back to your original payment method. We apologize for any inconvenience this may have caused you.

@Tanya john then it would be a bigger violation called fraud because they are still the federal government, we have to find documentation to prove the statute they violated. they emailed me about my complaint saying it’s in their internal SOP

I traveled to El Salvador in November, and at the Boston airport they also charged me $1,000 for parole. I asked why, since I have a pending I-485, but they didn’t care. I traveled to Colombia in January, and when I came back, they didn’t charge me.

@iris p email cbpinfocenter@cbp.dhs.gov list the name of the CBP port you entered and explain what happened and attach all your evidence (receipts etc. and receipt for the charge and the stamp in your passport if any). say: I must respectfully note a legal discrepancy in the internal guidance cited. My Form I-485 (Receipt #) is a filing for Adjustment of Status specifically under Section 245 of the INA. While the underlying petition is a VAWA I-360, the 'benefit sought' is indeed Adjustment of Status. By categorizing all VAWA-based I-485 applicants as 'other than AOS under INA § 245,' CBP is effectively re-writing the statutory definition of Section 245. I will be seeking further review of this interpretation through the DHS Office of the General Counsel and the CIS Ombudsman.
