it’s pretty close , my PD is oct-13-2015 (other countries). in case I apply and the final action date move forward will I lose the possibility to do a consular interview ? would this delay my case even more ?

Yes if you apply for adjustment of status your date has to be current in order for you to get your PR. I had my interview based on my adjustment of status in May 2022 and I’m still waiting for my PD to be current. My PD is June 2016. Once you file for adjustment of status your case is handled by Uscis not Nvc and depends on your local field office. You can check case processing time by selecting form 486 and then your local field office though I think it takes more time to schedule an interview internationally since the backlog is huge but if you are in the US you have the option to get interviewed early and whenever your date gets current they will issue your PR, still not sure about processing time in your state I’m from Virginia so things can be different.

you have to change your address first at USCIS inorder to have an interview and biometric appointment here in the US i think that will expedite your application

just got a response from my consulate (rio de janeiro): We kindly inform you that cases current today will be schedule for April. (mine is not current, but very very close)

no I mean, even if my date becomes current (which is not) I would have to wait 3 months for being interviewed in my consulate

from what I’ve reading the reason why the dates didn’t advance is that in the beginning of the pandemic (and until June-2021) USCIS moved the dates a lot but didn’t have consular capacity to interview everyone, so they are still doing that (plus other priorities like F2A).

so they should continue advancing once they cover this backlog, but I don’t know yet how close they are

I think you should apply adjustment of status then you will waiting for your date becomes current you can have your interview in USA i think this is much better. if you come back your country your dates will be delayed

yeah, I’m not sure if it’ll make much difference but I’ll have another conversation with a lawyer by the end of this month

yes, I currently have a L2 but I’m also working on a H1B and EB2 in parallel to my F2B. your PD is current, why were you not interviewed yet ? did you try to contact your consulate ?

they just send an email after two months that your case is still in queue and slot is not available yet due to covid . i am very confused . if we email NVC they said its totally depends on Your embasy and if we email Us embassy they said your case is not in embassy yet its still at NVC .

you should send a out of processing request for your case. that sounds like something is being miscommunicated?

yes, I would look for an immigration lawyer to understand what’s your best action. your case is long overdue considering that your visa is available for a long time and all you need is an interview
