Change of job on EAD - AOS pending
Hello,
My I-140 has been approved and I-485 has been pending for over 6 months now. I have an EAD + Advance Parole that are valid till 2028/2029. I believe under AC21, I should be eligible to change employers as long as my current and new job are in the same or similar category.
As I speak to potential employers, I am asked if I need employer sponsorship - Do I really need one ? And how does that play out from a cost perspective for the employer ? I believe I would simply need to file I-485J which is free of cost - other than that is there anything that I would need assistance with from my future employer ?

thanks ! you mean any future employer doesnt really need to incur any cost in my case ? other than probably provide me with an attorney who can be my attorney on record for the pending 485 application so that i can change the current one ? and incase they arent willing to do so, i can have my own attorney as well who can take my 485 application forward ?

New employer should file 485J. I was in your same situation and my attorney (Nee employer) said it is must to file. I had an interview and the officer asked me few questions on my new 485j as well.

@M N thanks ! yeah i will file 485J but looks like there is no cost associated with that.
at this point i am just trying to understand if i have to join a new employer, what kind of costs would they have to incur (a) for 485J (b) to support my pending 485. once i have that clarity, i shall be able to accordingly have conversations with recruiters because a lot of them have been saying they cant “sponsor” me due to associated fees etc.
also the interview you are referring to is I believe for the final 485 adjudication, correct ?

I though If it is EBA1 self petition you are restricted to the AC21 job portability, 180 days?

@M N Is your case EB1C ? Is it possible to change the employer with EAD, while 485 is pending for EB1C?

yes mine is EB1C and we can switch jobs after 180 of approved 140 and EAD in hand.

@A S - No cost to file and it is just a attorney fee which my new employer paid… the interview is for 485 and it was approved after 153 days.
