From “Case Remains Pending?? (EB2-NIW ROW)” to “NEW CARD IS BEING PRODUCED”
PD: June 2022. Case status changed to “Case Remains Pending” in July 2023.
Got RFE for dependent (proof of bona-fide marriage) in September 2023. Weird for NIW, but okay.
Case still remains pending, before and after responding to RFE. USPS says package was delivered. No update from USCIS though
Chatted with Emma twice, live agent keeps saying case is processing normally.
Starting to get a bit frustrated, especially after seeing approvals for people with later PDs.
What can I do next?

Less than 3 hours after I posted my complaint, I found that our cases have been approved
God is rarely on time, but He’s never late!
I’m overflow with so much emotions right now.

Hello Francis, congrats! So basically it took 40 days after your PD became current to receive your approval, am I correct? my PD becomes current next month and I’m wondering how long I should expect after that.

Congratulations!!! Did USCIS issue you an EAD while you waited for your PD to become current? If “no”, do you know if they do?

@R A That’s fairly accurate. We became current in August and got approved in October. That’s closer to 60-70 days.
Hopefully you get approved soon as well

@Olive Green Thank you. Yes, in May 2023, we got the EAD Combo card even though our PD wasn’t current.

@Olive Green No. We filed I-140 in June 2022. Got approved in November 2022. Then applied for I-485 in December 2022

@Francis R You mean you filed I-485 before your date was current? interesting!? I was told it will get denied if one applies before their PD is current. Also, do you mind me asking what country you are from? Trying to piece together the timeline and PD.

@Olive Green The retrogression only happened early 2023. As at the time we filed the I-485 in 2022, we were current.

congratulations Francis, from Ghana too and waiting. Crp since April, PD is August 2022 though . What proof did you have to show for the bonafide marriage? We did only marriage certificate so wondering. Thanks

@ Thank you. We still think the RFE to prove our marriage was unusual for EB visa category. Regardless, we sent our joint bank statements, joint health insurance, apartment lease, photos, marriage certificate (again), state ID and some records of our WhatsApp chats
