Case finally approved
I was in the Oct 2020 cohort of marriage based AOS applicants whose case was stuck in limbo. The lawfully community helped me put many things into perspective. So, I’m glad to share my timeline. The AOS was handled by the Baltimore FO. We were scheduled for interview in November 2021. Interview went smoothly. They had us in and out in 30mins (15 min interview + 15min logging our information into the system). Officer assured us we’ll hear back in 30 days, but handed us the obligatory 120 day held back for review notice saying that a supervisor has to sign off. We were concerned when we saw that the FO, like others, was in the middle of a digitization process. As we feared, we never heard back from the office. So we waited for about 5 months after the interview and contacted our senator and our district representative - April 2020. The latter reached out to USCIS and informed us that his office will revert after hearing back from the FO - March 2022. My EAD was approved in June after submitting a case out of processing time request - approved 1 week after request. Last week of June, I submitted a similar request with the I-485 application and proceeded to log a FOIA request for my case file and my case got approved on July 02. #BaltimoreFO #Potomacservicecenter #NBC

DT TD Congrats! Did USCIS respond to Senator's inquiry? I'm past 3 months wait after interview at Baltimore FO and I'm thinking which path to take after reaching 120 days.

what’s FOIA,we interviewed at the Baltimore office on June 25th 2021 and we haven’t received a decision yet . I submitted a case out of processing time request about a month ago and this will be my second one but haven’t gotten a response yet . I also submitted something through ombudsman just yesterday hopefully I get some answers

@S N, Thanks. I don’t believe congressional assistance was effective in my case. The senator’s office sent us what felt like a generic letter stating that USCIS has 11 more months to process my case. The district representative sent a more compassionate letter stating that his office has reached out and will get back to me when they have something concrete and asked us to contact someone in his office should we need help with something else. So, I have doubts than know for certain if any of it helped. But that shouldn’t stop anyone from trying.

@ Mr Wilson, FOIA is a freedom of information act request - in this case for one or more of your USCIS application files. I did that in the hopes of finding out where in the process my application got stuck. Fortunately,, USCIS got back to me with a decision on my case. So, the FOIA request is still pending. The Baltimore FO is busy like other FOs in metropolitan areas. So actively checking with them maybe a good idea. I submitted four case out of processing time requests for the I-485 and one for I-765. I have also called numerous times despite warnings to let it play it out.

Congratulation! Happy to see something moving. We had marriage based green card interview in Baltimore in September 2021 and we have no decision until now. Our lawyer submited two times the out of processing time request but everything it came back that we are in normal processing time. Not sure what we should do next to get the decision.
