yes we have evidence and I was staying in different state for business and visit her every once a month for 10 days since last years due to covid

When you refile, make sure you put airline tickets, a lot of pictures of you two with friends and family, affidavits from friends and family attesting that they know you and know your living arrangements

Casue we did not married for not fraud if thay charge me fraud I’ll fight back

No they won’t charge you for fraud, they only denied your for insufficient evidence. I am surprised they did not issue RFE or NOID before denying

Get a lawyer and appeal the decision. Refiling with the same evidence will only really result in the same decision.

You always have a chance to refile again and your case will be handle by a different interviewer who can get you guys approved.

@Eric D. He was denied for insufficient evidence not for fraudulent evidence. H eju at needs to add way more evidence to what he originally submitted and he will get approved

My i130 just got approved yesterday and my interviewer assure me she’s going to approve the i485 as well. she’s just waiting on a documents to come in then she will approve it.

I’ve been with my wife for almost 5yrs now and we married in early 2019 and filed 2 months after. so I’ve been waiting since 2019 and got tired of waiting so I had my wife call them and they immediately setup an interview a month after calling them. before we married, I lived in another state and I still even lived in another state during marriage due to work and moved back after almost a year away but I’ve visited and kept all my flight and gas receipts just in case you know. we were questioned about that and we both explain to the interviewer and we were good. cos people do travel for work so there’s no way they can hold that after you.

Don’t be afraid to call them and let your wife talk to them with confidence and ask any questions on you guys mind without feeling like you’re disturbing them you know what I mean.

If he refiles instead of appeals he will have to wait the entire length of the time again, appealing is quicker
