Cancellation of tourist B2 visa and 5-year penalty
Can anyone tell me what type of waiver is required to re-apply for a tourist visa that was canceled when the person was entering the U.S. because the last entry was for 8 months (6 months initial + 2 with extension) and was trying to re-enter with only 3 months of being abroad? The visa was canceled at the port of entry by CBP and he was given the 5-year punishment. I would like to know what kind of waiver and if you know the cost to be paid with the average processing time. THANK YOU.

I had this issue with a 10 year ban. and there was nothing I could do, when I mean nothing. it’s so hard to get a waiver approved and a long time to get a review on your case, it’s a big liability when previously overstaying. I waited 8 years and then got approved for my O-1 visa and had to submit a waiver with an additional 3 month wait time. this was a waiver that the department of state submitted for me and recommendation due to my visa.

the waivers that the department of state sends in are faster than a normal waiver but you have to have a minimum time left of the ban. only other option is to get married etc. but with a ban, it’s a long time 1.5year +++
