Can my fiance apply for a b2 visa while waiting for her k1 visa?
Hello, its been about 6 months since my fiance applied for her K1 visa (I-129F) can she apply for a B2 visa (tourist visa) while waiting for her fiance visa to be approved? seems the tourist visa is getting approved allot faster. Does it sound like a good idea to do this and have her visit me in the US for a little while waiting for the K1 Visa to be approved?

technically she can apply for tourist visa, but she must state that she got a pending k1 application and she’s visiting her fiancé in the US.

I hate to burst your bubble but most likely not! all the people I know that had a pending application got denied a non immigrant visitors visa cos you already stated your intentions to immigrate! makes sense?

Your fiancé cannot apply for a B2 visa because the K-1 is already started. So, unfortunately you can only choose one or the other.

I don't see why she cant? no law stating that she isn't able to apply for it. now will she get approved is another story, but worth a shot!? plenty people stating as long as she shows her intentions of coming back and not staying is a good chance of getting approved for it.

okay here is the info your looking for.
#1. Yes she can apply for the B2 while the K1 is pending.
#2. The B2 will instantly get denied because she had a K1 in progress.
#3. The reason it will get instantly denied is because they fear that if they approve her B2 and then if she is denied on the K1 that she will not return home when she is suppose to, and she will stay in the USA even though she was denied.
#4. Yes this is the crappy truth, the government will not tell you this, but they are okay to take your money for the B2 knowing it will instantly get denied.
#5. if you talk to a lawyer they will advise you not to file for a B2 because it will always be instantly denied. so in the long run it would be better that you not file for the B2. saves you time, stress and money.

I have heard from several sources that you can apply for a tourist visa. The issue is that the petitioner still has ties to their country. My fiancée is applying for a two week tourist visa, but she has a job and a minor son that is also coming with her that is on the pending k1 application when she comes here permanently on her K1.
