can muy husband get deported at his i485 interview?
my husband has his interview July 14 but he is in removal of proceedings for a pending asylum and his master court is August 14.
we are worried that he may get deported at his interview.
any similar situations?

If the I-485 application is valid, it means that a person is already under temporary status. A person who has the chance to adjust their status cannot do so arbitrarily or due to an asylum application. There is no law in force. If the 485 application is approved, they already have a green card. The asylum court is automatically disabled and cannot be affected by the decision.

contact a lawyer, if he's in removal he can get detained at interview

uscis can't interview him for I-485 If he's in removal, the interview will be for the I-130 only, if approved then he will ask the court to terminate his removal proceeding when he's not in removal anymore then uscis will have jurisdiction in his case then schedule another interview for I-485. he will nor get deported if he's in removal proceedings. you need a lawyer still.

what @Max power said is absolutely correct but I’ll advice also bring a even if he get detained it’s not like the lawyer can do anything about that but they can find way on getting him out just have faith also did he filed his I589 with uscis or the EOIR court? @Erandi Zuniga

@Nathan Starboss🇯🇲📌 with EOIR, the lawyer told us that USCIS has jurisdiction because he was checked at port entry and has parole as arriving alien.

if it’s with EOIR court uscis does not have jurisdiction over the case the cause has to be dismissed in the court first but if that what your lawyer say your in good hands
