Can I stop paying the tuition while GC haven’t approved yet ?
My green card application (EB3 skilled) is still pending, but I-765, I-140 and I-131 have been approved. I am currently on a student visa and must maintain active I-20 status by paying tuition. I'm wondering what would happen if I stop paying my tuition. Can I do that?

you can do that as you have a legal status through AoS but still it’s better to ask the lawyer

Yes, you can do it. Contact international office and mention them about AOS. Once you submit some documents, they will start charging you in-state fee. However, you still need to take 12 credits to maintain your status.

You can stop going to school once you are pending i-485 but there are risk to it. Its your decision to stay as student and pay or start working for your sponsor using your ead.

That is the reason its a risk because you cannot go back to your previous status when you use your EAD already or stop going to school.

I am in same situation..but my lawyer said it’s okay not to go clz. But my status will be pending. so right now I am only working.

@Teerayut New I think you will still be in f1 status unless you use your EAD. According to student advisor, I was informed to take 12 credits and use CPT instead of EAD to maintain f1 status. In case of denied GC (sorry just creating scenario), you will be back to F1 status. As AOS is just an adjustment to status and while you are enroll in 12 credit, college will let you pay state fee but still will count you as an international student (which is good). So, it is best to discuss with your international office and explain about AOS.

Also keep in mind that F1 status doesn't let you work outside without CPT, and might even have 20hr/week limit in some cases. So if you do work for your sponsor at any time before GC is approved, without cpt or 20+ hours (if applicable), you'll violate F1 status anyway. So might as well stop tuition now and use your GC ead.
