can I continue consular after overstaying
I basically started my application in my home country , And came to visit my husband with absolutely no intention of overstaying. The situation was that our dog was 16 years old so I came so they can spend some time together because I don’t believe that she would’ve lived before my visa was approved. naturally, I ended up staying because My dog died within my allocated time. But my husband and a lawyer I know, told me that I would be able to stay and adjust Instead. It was a hard decision, As a you would complicate the process further but I stayed to support my husband as he worked and grieved.
My tourist B2 visa expired in December so it’s only been a few months, Less than 180 days. we haven’t filed any extensions or any sort of adjustment of status just yet, But because I’m in consular processing, would I be able to go back to my home country since it’s less than 180 days overstay? Does anybody know what form to file To return without penalty. We finally got an active review a year after submission today. So now I’m wondering if I should just stay in the country And adjust or if I should go home and complete the counsellor processing, as that would be way faster for me Obtain my green card that way.
has anyone been in a situation where there overstayed while waiting for consular processing ?

don’t go for unlawfully present you have to wait 3 years of perdon if you go to your country .. adjust your status in USA if your husband is us citizen .. forms I-485 ,I-765 affidavits of support and medical exam
