Can I change my name during divorce?
Hi, I got my green card last year for 10 years through VAWA. I want to change my name back to my maiden name. My name right now is FIRST NAME, LAST NAME, MARRIED NAME. I want to change it back to my FIRST NAME, LAST NAME while filing for divorce. My country passport right now only has my maiden name on it and I haven’t had any issues. Now, my question is, if I change back to my maiden name during this divorce, will my green card still be valid and at naturalization, I just apply with my married name and click on name change on there too? or will I have to file a I-90 and get a replacement green card with the maiden name on it? basically can I just carry on using my green card with my married name until I apply for citizenship in 3 years?

you have to change everything so a lot of people don’t change their marriage names. it’s just a lot of burocracy, paperwork and money to change everything.

Thanks Daniel, the only thing that has my married name is my green card and driver’s license. I dont mind the paperwork. the divorce form asks if I want to change my name and they will give me a divorce decree with the changed name. my issue is, will the name change affect the validity of my green card and I have to get an updated one when I change it? or if I leave it and have that divorce decree and the name change confirmation from the court, that will be enough? and then wait for another 3 years to put that change on my naturalization paperwork and attach the name change with the divorce decree?

You will be asked at the final hearing of your divorce if you want your maiden name back to you or want to keep this you have, just tell them you want to have it changed and it will be noted in your divorce decree and you can use that as court documents to change your name on every documents

Name changing won’t affect your GC validity and also if you want to want to wait you can have it change when you applied N400

I think it would be better you get everything,I mean your naturalization and then proceed to change whatever you want to change.my advice though

thanks all, I just left it as is and will just wait to change it at naturalization at this point. thanks for all the input

I’m also in the same boat as you, I was told to wait and do it during my naturalization
