Can a pending asylee get employment based sponsorship
hi guys…. I’m currently a pending Asylee since 2017. I have American kids. working actively in healthcare and when I tracked my case it says next step is an interview. The problem is it has been saying that for a while now. I’m actually in health care and a Licensed nurse now and was wondering if I could get an employment based sponsorship to take my application to the next level. I’m actually looking for health care employers ready to take it up and support my immigration process. I was wondering if anyone has tried this and what are the odds of an aprooval., or if there are recommendations for a good lawyer who has experience in such a case. If your kids are citizens then they can petition for you however if they are still below 21 then you have to wait. If you file for an employment based (eb3 skilled) you should a have bachelors degree in your healthcare field, pass all exams, and have your credentials screened for evaluations (took me 2 years to processed with expedited processing). There are two types of licensed nurse (LVN or RN) if you are an LVN that might be tricky as it would not pass the minimum requirement for immigration as bachelors degree is needed. If I were in your shoes I would rather wait for that asylum case instead of doing the EB3 because you have to file again for an i-140 plus i-485. The timing is not also right as the PD is now 2020 you have to wait for it to be 2023 before you can file for that i-485.

@J A EB3 visa sponsorship does not requirea bachelors degree - an associate will do (if trained in abroad). If trained abroad - as long as your traininh is evaluated to qualify you to sit the NCLEX exam you good to go. Most nurses qualify under the EB3, those with a bachelor can qualify under EB2 depending on years of experince.

@Praise God each country has their different equivalent I am not from UK so I am giving a general advice. There is also a misconception that if you were able to sit for an NCLEX you could already be good. Bear in mind that is only the licensing part however there is also the immigration side which is CGFNS which you need to file for your I-485. It could also go the other way around. I saw a lot of nurses crumble there dreams due to lack of research and ill advised which caused them there future.

J A l am sorry to say you seem to not understand EB3 for nurses - you don't have to have a degree. As long as CGFNS and other accrediting organizations approve your qualifucation and can write NCLEX and have 2 years experience you also qualify for Green Card sponsorship. Please, do your research again!

Haha! i just laughed @Praise God. Sorry but you are referring to eb3(skilled) I am referring to eb3(professional). Please save me the teachings I am done with the process under eb3 nurse (professional) and working now. FYI not all states accept CGFNS and do not interchange “degree” vs “license”. You need to have a degree to be skilled but you are not required to have a license in your home country as long as your degree has an equivalent baccalaureate credentials in the US. Good day!

@J A why you mad - because someone: - has a different opinion to yours. - the author of this post stated that she "is in healthcare ...... and a licensed nurse" why did you assume she needs a degree to be a licensed nurse? - she also aske ".. wondering if l could get an employment based sponsorship....?" - YES she can get a sponsorship whether she has a degree or not as long as she has her license - of which she said she has. - why you talking about "EB3 professional license for?? - in my last post l did acknowledge that its not only CGFNS that provide healthcare credentialing as stated "As long as CGFNS AND OTHER ACCREDITING/CREDENTIALING ORGANIZATIONS...." - as far as l am concerned you are the one giving wrong advise. WHY YOU SO MAD THOUGH - ITS NOT A WINNING CONTEST - we all want to help Bella make a decision right!

@A J - your brain storming tone is rather aggressive though, no need for that, we are all going through a stressful journey. - a lot of nurse don't have a bachelor's degree and are being sponsored left right center, and they are getting their green cards without issues at all. Glad that your tone is chilled at last - have a great weekend.

have you been out of status more than 180days?! if so, the only way you can get the waiver that is required as a part of you I485 is through being an immediate relative of US Citizen or VAWA. otherwise, you can go through other employment based path and you will get approved for I140 but your I485 will get rejected and you will (depending on the officer) will be placed on removal proceedings. so the best is to push for your asylum case to go to court or your kid turn 21 and they apply for you and act as waiver.
