Backlog Clearance is Dead!
While I am happy to see the EB1 progressing forward in this VISA bulletin, it’s frustrating to see that older cases are not getting closed. What is the point of progressing FAD when the backlog with NBC and FO are not getting cleared? The people who are happy today will get frustrated later on. #MondayRant

absolutely! there is no point in progressing when lot of old cases are pending to be cleared. As I know there are PDs as old as 2015 are pending to be cleared with no RFE or any complications! Simply for displaying that USCIS is making progress they are progressing giving false hope to people who are waiting for final action date and adjudication

its frustrating! I think the CPR cases are the unlucky ones. Funny part is USCIS response to my congressman’s enquiry - we process the request as it was received and are placed as per the priority dates. There are new cases getting approved where the priority date and filing dates are recent than many CPR cases!

well there is another side to the coin, the old cases are majorly ‘ported’ from eb2/eb3 and people who are net new eb1 from 2021/22 are waiting for long, meanwhile more porting causing backlogs. 2022 cases needs to be cleared as well, hence really happy about the improvement.

@Rick S absolutely right thank you for this comment. Most of the porting individuals applied in 2023/2024 impacting net new EB1 applicants in 2021/2022 so this visa bulletin move is much needed.

imo porting is right or wrong is more like chicken or egg question and doesnt lead to any solution, its been there from ages and anyone who qualifies attempt it .straight filers cannot stop it because its not illegal to port, folks who are doing it are indeed doing it because they qualify as per the rules allowed by usics. but i do agree it slows down the visa number allocations to straight filers because someone else jumped the queue.

@M S The debate on whether Porting should be allowed or not can go on for days. In my opinion the priority date should be the date you “qualify” for that category (For example if you finish bachelors in 2015 and masters in 2017 you cannot claim that you finished your masters in 2015 because the criteria is different). Having said that individuals porting are following the law as it states today so nothing wrong in that either. As @Hello World said my priority date is not current yet either but I’m very happy with the visa bulletin move and hope it continues.

@S J by saying “priority date should be the date you qualify” you killed the debate 😂. the main and only benefit of porting is bringing the earlier priority dates. And I hope the dates move to current by Oct bulletin. All the best!

@RW BM I think you are misinterpreting the initial post. I think its trying to say whats the point of moving the FAD as those will also be in the queue. I don’t think they are trying to say FAD should not move. FAD must move as per the visa availability and applicants should be able to take benefits like EAD and AP while waiting for adjudication. I think the CPR team is just trying to share some frustration thats all. If someone is saying dates should not move until backlog is cleared is absolutely wrong!

@RW BM The response to my congressman from USCIS looks positive. There are lot of visa numbers available and hence the backlog of cases, which is refletive in the july VB. My prediction it will be again current for EB1 for Oct VB. What’s you PD? Hope it will be picked up soon!

@RW BM Yes I did reach out to congressman but not sure if that was the reason as I was noticing last few days the number of cases approved increased for my receipt block 239071.
